Anon,

I received the following letter from the Department of the Premier and Cabniet today.

"Dear Mr. ******,

RE: FREEDOM OF INFORMATION CONSULTATION.

The Office of the Premier is dealing with an application under the Freedom of Information Act 1991, the applicant is seeking access to:

"Copies of all documents contained in the files of the Office of the Premier regarding the Church of Scientology under the Freedom of Information Act. This would include, but would not be limited to, complaints, reports, recommendations and/or similar documents from the past 5 years."

The purpose of this letter is to obtain your view as to the disclosure of the attached document. This document contains information regarding your personal affairs. By virtue of Section 26 of the FOI Act, I may not release this document unless I have taken reasonable practical steps to obtain your view.

If you object to the disclosure of the document please advise in writing. Your response should indicate whether or not you consider the document to be exempt and give reasons for your objection to its release.

The Accredited FOI Officer has the right to determine if the applicant should be given access to the document under the Freedom of Information Act. In this event, you will be given the opportunity to appeal my determination.

Alternatively, if you consent to the release of the document, a short letter or email to (*******@dpc.sa.gov.au) would be appreciated.

I would be grateful if a response could be received by Tuesday 8 September 2009. If you are unable to respond by then, please contact **** ******** on **** *****.

The letter refers to an email sent by me to the Premier in August of 2008, questioning the status of the CoS as a tax-free organisation, as a part of Anonymous-related activities. Simply put, if you have sent similar emails/letters to the Premier, or to any other politican, I'd be careful. On that note, has anyone else here received such a letter?

I am in the process of seeking legal advice in relation to this matter, and I shall advise you all of the outcomes of this case. I thought I'd let you all know what's happening though.

I will provide a scanned copy of the letter if requested.

Cant you ask who's applying for the info?

but yes, this is a timely reminder of keeping in mind that if you put your name something into anything governmental, records pretty much have to be kept.

use an anonymous email address, or something that has no link to you.

It would be cool to see a scanned version :) just black out your name.

I will endeavour to have a copy up some time tonight. :)

I can make an offical request, in writing, to see who is doing the sluething – but it's a rather argous process.


Purportedly, Nick Xenophon is seeking a whole heap of info in relation to CoS – but that is not the offical view of the FoI department. They, instead, maintain that such information is to remain confidential unless I make an FoI application – and even then it is not guranteed.

The Anon over at whyweprotest have informed me that Xenophon is after the dox, and that there are methods of appealing. This has been further substantiated by my solicitor, who is currently discussing the matter with the Government on my behalf.

I will post some links pertaining to FoI laws for Anon, as I believe it may come in handy, whether for reference or otherwise. There are many legal grounds in which to challenge such a request, and I shall post these ASAP.
